Alleged breach of order: Court okays contempt charge against Transport Minister

Amaechi advises tricycle and motorcycle riders on regulation

A Federal High Court, Abuja, on Wednesday, directed commencement of contempt proceedings against the Minister of Transportation, Rotimi Amaechi, following allegations that he flouted earlier court order.

Justice Donatus Okorowo gave the directive after counsel for the plaintiff, Abdulhakeem Mustapha, SAN, informed the court about the development.

Mustapha said that Amaechi allegedly violated an order to maintain status-quo issued on Jan. 22 in a suit filed by the Incorporated Trustees of Citizens Advocacy for Social and Economic Rights (CASER).

It was reported that CASER had challenged Amaechi’s handling of the process of appointing operators of the International Cargo Tracking Note (ICTN) in Nigeria.

In the suit marked: FHC/ABJ/CS/1587/2021, it alleged, among others, that Amaechi manipulated the appointment process to the benefit of two local and inexperienced firms – Medtech Scientific Ltd and. Rozi International Nigeria Ltd.

Listed with Amaechi as defendants in the suit are the Bureau of Public Procurement (BPP), the Attorney General of the Federation (AGF), Medtech Ltd, and Rozi Ltd.

At the resumed hearing plaintiff’s lawyer, Mustapha told the court that Amaechi defied the order for the maintenance of the status quo and continued with the appointment process and is currently on the verge of completing the process of appointment.

“He (Amaechi) has taken fundamental steps on the subject matter of this suit, and we have documents to be placed before the court to establish that he has ignored the order of the court completely.

“In order to protect the sanctity of this honourable court, we have issued Form 48 against the Minister of Transportation. With the commencement of this committal process, which takes precedence over any other matter.

“We urge this court to suspend further proceedings in the substantive suit,” he said.

Mustapha said having issued Form 48 on the minister, he was in the process of filing a motion on notice to commit the minister to prison.

In response, Amaechi’s lawyer, Omosanya Popoola, admitted receiving a letter notifying him of the issuance of Form 48 on his client.

Popoola said his client is a law-abiding citizen and he was yet to be personally served with Form 48.

Lawyer to BPP, Akin Olujinmi, SAN, said his client had also not been served with the Form 48 personally as required by law.

Olujinmi argued that there was no motion for committal before the court, adding that the plaintiff’s lawyer had to file an affidavit to establish his allegations that the defendants, including Amaechi, had violated the court’s order.

On his part, lawyer to the AGF, Mohammed Sheriff aligned himself with the defense lawyers’ submissions that proceedings in the main suit should not be halted.

Justice Okorowo agreed to suspend proceedings in the main suit, noting that: “Once the issue of contempt is raised, the court must suspend proceedings.”

According to the judge, the court will not close its eyes when being told that its orders are being flouted.

“We have to suspend proceedings for the court to ascertain the veracity of the allegations,” he said.

The judge then directed the plaintiff’s lawyer to proceed to file a motion on notice with an affidavit to establish the facts of the alleged violation of court’s orders, which must be filed and served before the next adjourned date.

Also, a firm, Antaser Nigeria Limited, in an application, prayed the court to be joined as a party in the suit.

Antaser’s lawyer, James Ogwu Onoja, SAN, told the court that his client was a necessary party in the case because it sought to participate in the bidding process but was unlawfully excluded.

CASER, in an affidavit supporting the substantive suit, alleged that the purported procurement process, leading to the appointment of the 4th and 5th defendants (Medtech and  Rozi) as companies providing ICTN services showed that it was riddled with non-compliance with the known procurement procedures as stipulated in the law.

“The failure of the relevant agencies to follow due process and appoint qualified companies contributed immensely to the failure of the ICTN project in the year 2010 and 2015,” it averred.

The group then sought an order nullifying the entire process of appointing the 4th and 5th defendants as operators of the international cargo tracking note in the country, among others.

Man Docked For Alleged Attempt to Kill Father

…As Court remands man, 44, for allegedly defiling 9-year-old girl

A Magistrate’s Court in Gwagwalada, FCT, docked a computer instructor, Samson Abayomi for allegedly attempting to kill his father with an axe and knife.

The police charged Abayomi, who resides on Jeremiah Oseni Road, Gwagwalada, Abuja with criminal intimidation and mischief.

The Prosecution Counsel, Dabo Yakubu told the court that on Aug. 2 the defendant allegedly entered his father’s apartment, Mr Bello Samson with an axe and a kitchen knife to kill him.

Yakubu said that Samson was rescued by a neighbour and in the process, the defendant allegedly destroyed his father’s vehicle windshield valued at N50,000.

He said that during the police investigation, the defendant allegedly confessed to having used a stick to commit the act.

He claimed that the axe and knife used act was recovered from the defendant.

The prosecutor said that the offence contravened the provision of Sections 397 and 327 Penal Code.

The defendant, however, pleaded not guilty to the charges.

The Magistrate, Olatunji Oladunmoye admitted the defendant to bail in the sum of N500,000 with two reasonable sureties in like sum.

He ordered that the sureties must reside within the jurisdiction of the court and adjourned the case until Sept. 18 for hearing.

In another development, a Badagry Chief Magistrates’ Court sitting in Lagos, on Wednesday remanded a 44-year-old man, Sunday Lukas, in custody, for allegedly defiling a nine-year-old girl.

The Chief Magistrate, Mr Patrick Adekomaiya, ordered that Lukas be remanded at the Awarjigoh Correctional Centre, Badagry after he pleaded not guilty to a count charge of assault.

He ordered that the case file be duplicated and sent to the office of the Director for Public Prosecution (DPP) for legal advice.

Adekomaiya, however, adjourned the case until Oct. 28 for a ruling on the bail application filed by Lukas and for DPP’s legal advice.

Earlier, the police prosecutor, Ayodele Adeosun, told the court that the defendant committed the offence on May 28,  at 12.20 p.m., at No. 4, Aribena Site, Ijanikin area of Lagos.

He said that Lukas indecently assaulted the nine-year-old girl by inserting his fingers in her private part.

The prosecutor said the offence contravened Section 135 of the Criminal Law of Lagos State, 2015.

Anti-Bullet Charm Trial: Native DOCTOR IN POLICE NET FOR Allegedly Killing Client

Police in Edo have detained a teenager, a native doctor after his boast an Anti-Bullet proof charm failed, and his client sustained wounds which resulted in his death

The police detained the 19-year-old native doctor, Timothy Dauda, for allegedly shooting his client, Alex Ezekiel, to death during the “anti-bullet” charm trial.

The Command’s Public Relations Officer, SP Moses Yamu, confirmed the incident to the newsmen on Monday, saying that the incident happened on August 20 in Onumu Community, near Igara, Akoko Edo Local Government Area of the state.

He said the suspect was arrested by operatives from the Igarra Divisional Police Station in Akoko-Edo.

It was learnt that the suspect allegedly claimed to specialise in preparing charms against gunshots and machete cuts.

A source further highlighted that the deceased had visited the native doctor’s home to obtain the charm.

It said that “in a shocking turn of events”, Dauda attempted to test the efficacy of the charm by shooting the client with a gun.

The charm was said to have failed as he sustained fatal injuries.

“When he was rushed to a hospital in Igarra, he was pronounced dead by a medical doctor,” the source further said.

Meanwhile, the police spokesman said the suspect would face prosecution as soon as investigations were concluded.

Bello-Koko: EFCC Nabs Suspected Syndicate Impersonating Olukoyede To Dupe $1m Fraud

 The Economic and Financial Crimes Commission (EFCC) has apprehended a four-man syndicate for allegedly impersonating and blackmailing its Chairman, Mr Ola Olukoyede, in a one million dollars fraud.

The EFCC Spokesperson, Dele Oyewale, said this in a statement on Thursday in Abuja.

He said the suspects were arrested on Wednesday at Gimbiya Street, Garki, and Apo Legislative Quarters, Abuja.

Oyewale stated that the alleged fraudsters impersonated the EFCC Chairman and contacted a former Managing Director of the Nigeria Port Authority (NPA), Mr Mohammed Bello-Koko, for a deal.

According to Oyewale, they claimed that Bello-Koko was implicated in fictitious EFCC investigative activities during his tenure as NPA MD.

“The impersonators allegedly demanded one million dollars from Bello-Koko, threatening arrest and prosecution if he failed to comply.

“Upon receiving intelligence about the impersonators, EFCC operatives were deployed to collaborate with the alleged fraudsters, leading to their successful arrest.

“The suspects are currently in EFCC custody and will be charged to court once investigations are concluded,” he said.
