The Federal High Court in Abuja on Wednesday gave the court bailiff five days to serve former President Goodluck Jonathan with the witness summon, compelling him to appear in court with respect to the trial of a former National Publicity Secretary of the Peoples Democratic Party, Olisa Metuh.

The court also ordered the counsel prosecuting Metuh, Mr. Sylvanus Tahir, to persuade the Economic and Financial Crimes Commission to explore administrative means of ensuring that the Department of State Services produced the detained former National Security Adviser, Col. Sambo Dasuki (retd.), in court on October 31.

Upon applications by Metuh, the court had issued two separate subpoenas on Jonathan and Dasuki, compelling them to appear in court on Wednesday.

Jonathan and Dasuki were summoned by the court upon Metuh’s application requesting that they be ordered to testify in his defence with respect to the sum of N400m, which he was said to have received fraudulently from the Office of the NSA in 2014.

But the two summoned witnesses were absent from court on Wednesday.

Ruling after hearing the lawyers involved in the case on Wednesday, Justice Abang noted that without the two summoned witnesses appearing, it would be difficult for the court to make any progress in the case.

He also noted that while Dasuki had been served with the subpoena issued by the court, Jonathan had yet to be served.

He noted that, therefore, the ex-President could not be blamed for failure to attend court on Wednesday.

But the judge held that a singular attempt by the court bailiff to serve Jonathan personally with the witness summons in Abuja was not sufficient.

He, therefore, directed the bailiff to take further steps to ensure personal service on Jonathan within five days from Wednesday.

He said if after five days the bailiff was still unable to serve Jonathan personally, Metuh, who was the one who applied for the subpoena, should kick-start the process of serving the ex-President through substituted means.

Concerning Dasuki, Justice Abang noted that since the prosecuting lawyer, Tahir, was handling the case on behalf of the Federal Government, which the DSS, the body detaining Dasuki, is its agent, the EFCC must  liaise administratively with the DSS to ensure that the ex-NSA was produced in court on October 31.

The judge ruled, “Col. Dasuki (retd.), His Excellency, Goodluck Jonathan, are not in court today (Wednesday) to give evidence in this matter.

“As regards Col. Dasuki (retd.), there is proof of service by the order of the Court of Appeal in appeal number CA/A/159C/17, has been complied with by serving the subpoena on the DSS to produce Col. Dasuki today. No reason has been offered and he is not produced in court today.

“As regards the production of Col. Dasuki in court today, at the subsequent hearing of this matter, this will be addressed administratively.

“From the judgment of the Court of Appeal dated September 29, 2017, it is stated that Col. Dasuki, in the custody of the DSS, which is an organ or an integral part of the Federal Government of Nigeria, the learned counsel representing the Federal Government of Nigeria in this matter must persuade his client, that is the Federal Government of Nigeria, to produce Col. Sambo Dasuki (retd.) in court at the next adjourned date, failing which it will be extremely difficult for the court to make progress in this matter.

“As regards His Excellency, Dr. Goodluck Jonathan, who is not in court today, it is on record that he has yet to be served the witness summon.

“The court cannot apportion blame to him for his failure to be in court today.

“It is my humble view that service of court process on the witness or a party goes to the root of adjudication, absence of which will nullify proceedings no matter how well conducted.

“It is not sufficient that the bailiff of court only made one attempt to serve him with the witness summon.

“On this, I agree entirely with the learned counsel for the first defendant (Metuh), Dr. O. Ikpeazu (SAN), that it cannot be exercise of due diligence on the part of the bailiff to have His Excellency, Dr. Goodluck Jonathan, served with the witness summon on only one attempt.

“The bailiff is hereby directed to make further attempts in effecting personal service of the witness summon on His Excellency, Dr. Goodluck Jonathan.

“Although the law does not state the number of attempts to be made in effecting personal service, one attempt, in my view, is not sufficient.

“The bailiff of court is hereby given five days from today to effect personal service of the subpoena on His Excellency, Dr. Goodluck Jonathan.

“Thereafter, the law will take its course.

“However, if personal service cannot be effected, it can be served by substituted means.

“For this purpose, the bailiff, under section 124 of the Administration of Criminal Justice Act, is an agent of the first defendant, Olisa Metuh, for the purpose of substituted service of process on His Excellency, Dr. Goodluck Jonathan.

“The bailiff is the agent of the first defendant for the purpose of substituted service. This is because the first defendant elected to call him (Jonathan), not the court.

“If personal service cannot be effected, it is only reasonable that the first defendant has a duty to apply for leave to serve His Excellency, Dr. Goodluck Jonathan, by substituted means. I so hold.”

The judge then scheduled both Jonathan and Dasuki to appear in court on October 31.

The court ruled, “In the light of the above, the matter will be adjourned again, at the instance of the first defendant, to enable the subpoenaed witnesses to be in court.

“This matter is, therefore, adjourned until October 31 to enable the subpoenaed witness – Col. Sambo Dasuki (retd.) and His Excellency, Dr. Goodluck Jonathan, to give evidence at the instance of the first defendant.”

Earlier on Wednesday, Justice Abang struck out an application by Dasuki, seeking an order setting aside the subpoena directing the ex-NSA to appear in court to testify on behalf of Metuh.

The judge ruled that having been ordered by the Court of Appeal in Abuja on September 29, 2017, to sign and ensure the service of the subpoena,  he lacked jurisdiction to hear and determine the motion on merit.

He held that determining the motion on merit would amount to an attempt  to review the judgment of a higher court, the Court of Appeal.

He held that all issues raised by Dasuki, through his lawyer, Mr. Ahmed Raji (SAN), had become academic since the court lacked jurisdiction to hear the complaints.

In the meantime, the Governor of Ekiti State, Ayodele Fayose, escaped death by a whisker on Tuesday after fire consumed his Mercedes-Benz G-Class on the Oshodi-Apapa Expressway, Lagos State.

The PUNCH learnt that the vehicle had just had a lone accident when the governor fled it and escaped into another car which was in his convoy.

It was gathered that traffic officials with the Lagos State Traffic Management Authority and the Lagos State Emergency Management Agency later responded to the incident.

A traffic official and witness said the driver of the G-Class, who waited behind until the fire was put off, later went in to pack some burnt N500 notes and other items in the car.

He said, “The accident happened around 1.30pm on the Oshodi-Apapa Expressway inward Airport Road. It happened on the Oshodi bridge, not too far from the LASTMA’s headquarters.

“We cannot tell the exact cause of the fire. We gathered from those at the scene that the governor was in the G-Class when the accident happened and he quickly escaped into another car in his convoy.

“On getting to the scene, we saw the driver who tried to cover his face with a Fez cap. He watched helplessly as the fire raged on. We alerted the state fire service and LASEMA. The LASEMA response unit had to take one way to access the accident scene because the road was blocked because of the inferno.

“On arrival, they were able to douse the fire. The vehicle was seriously burnt. The driver did not talk to anybody. We saw as he started packing some of the burnt cash in the car. They were N500 notes. He packed the money with some other items into a polythene bag. This was in the presence of traffic officials and the police. We later cleared the traffic as the carcass of the car was towed away by LASEMA.”

However, the Special Assistant to Fayose on New Media and Public Communications, Lere Olayinka, said the governor was not in the car.

In a statement he issued on the incident on Wednesday, Olayinka explained that Fayose was heading for the Lagos airport when the car got burnt.

He said the cause of the accident remained a mystery.

16 Dead, 28 Missing After Boat Capsizes Off Djibouti Coast – UN Agency

Sixteen would-be migrants have died and another 28 are missing after a boat carrying 77 people capsized off the coast of Djibouti, the second such incident in two weeks, the United Nations migration agency said on Tuesday.

The boat’s occupants included children, the International Organisation for Migration (IOM) said in a post on social media platform X.

It said its Djiboutian office was helping with rescue efforts.

Two weeks ago, the United Nations migration agency reported that 38 people, including children, died in another shipwreck off the Djibouti coast.

The International Organisation for Migration (IOM) said at least six other people were missing and presumed dead, and that 22 survivors were being assisted by the IOM and local authorities.

Yvonne Ndege, regional spokesperson for the IOM, said the shipwreck happened about 200 metres off Djibouti and that the boat carrying the migrants had left Yemen around 2 a.m. local time on April 8.

It sank about two hours later with around 66 people on board, predominantly from the Horn of Africa region.

They were believed to be mostly Ethiopian nationals, she said.

“Every year tens of thousands of migrants leave the Horn of Africa, mainly from Ethiopia and Somalia trying to reach the Gulf nations,” Ndege said.

“(But) thousands are stuck in Yemen. It’s rational to conclude that the group of migrants who perished in this tragedy was trying to return to Djibouti to buy time and try again later or return home.”

No fewer than 11 persons lost their lives while 16 others were injured, with one person rescued unhurt in an auto crash at Gaya junction along the Kano – Maiduguri road.

The Kano State FRSC Sector Commander, Ibrahim Sallau-Abdullahi, disclosed this in a statement issued by the Connand’s spokesperson, Abdullahi Labaran, on Saturday in Kano.

He said that the accident involved two vehicles, a Toyota Hummer bus, with registration number KTG 190 XB and a Hijet mini pick-up, with registration number KTG 501 YG.

“We received a call at about 03:45 p.m. on April 19, 2024. On receiving the information, we quickly dispatched our personnel and vehicle to the scene of the incident to rescue the victims at 03:55 p.m.,” Abdullahi.

The sector commander said that the accident occurred as a result of speeding and loss of control, which led to a head-on collision as two vehicles burst into flames immediately.

“The accident involved a total of 28 passengers in the two vehicles, out of which 11 lost their lives while 16 others sustained serious injuries, and one rescued unhurt.

“The injured were taken to Gaya General Hospital for urgent medical treatment, while the corpses were respectfully laid to rest in a mass burial ceremony”, Abdullahi said.

The sector commander, who lamented the occurrence of the incident, emphasized the importance of compliance with road safety rules and regulations.

He urged drivers to refrain from committing traffic offences such as speed violations and overloading of vehicles with passengers, animals or goods.

Abdullahi also advised commercial drivers to install speed limit devices on their vehicles to avoid crashes resulting from speed limit violations.

He said that the command was committed to ensuring the safety of road users, vowing,” We will intensify efforts to enforce traffic regulations to prevent similar incidents in the future.” 

 In another development, two persons died while three others were injured in an auto crash on the Ijebu Ode-Ore Road on Friday.

On Saturday, two persons died while five others were injured in another auto crash on the Ogun side of the Lagos-Ibadan Expressway.

Spokesperson of the Federal Road Safety Corps in Ogun, Mrs Florence Okpe, stated in Abeokuta on Saturday that one of the corpses of Friday’s accident was handed over to its family.

The second corpse was deposited at the morgue of a hospital Ijebu-Ode where the injured were taken, she stated.

She added that Saturday’s crash on the Lagos-Ibadan Expressway was a lone accident caused by excessive over-speeding by the driver of the Toyota car which somersaulted.

“The accident claimed the lives of a woman and a female child.

“Seven persons were involved in the lone crash in which five persons sustained injuries,’’ Okpe stated.

The injured victims were taken to a hospital in Sagamu while the deceased were deposited at the morgue of the same hospital.

NIWA Condoles Actors Guild Of Nigeria, Victim's Families Over Boat Mishap

 The National Inland Waterways Authority (NIWA), has conveyed its deepest regret over the unfortunate boat mishap which claimed four lives on Wednesday.

It could not yet be established whether or not, all the passengers wore lifejackets at the time of the incident.

A condolence message by Dakio Horsfall, the Acting General Manager (Marine) of the authority, on Thursday in Lokoja, said the management of the authority condoled with the Actors Guild of Nigeria and the victims’ families over the losses.

The mishap reportedly involved two boars on the River Niger en route to Asaba in Delta State at about 2:00 P.M. on Wednesday.

The accident, which involved an unregistered fibreglass boat with 12 persons on board and a privately owned wooden boat with a lone driver, left four persons dead, while seven others were rescued.

Horsfall said: “Preliminary reports indicated that the accident resulted from a frontal collision between the two boats due to overspeeding.

“Sadly, two people died at the scene of the accident, two more bodies were recovered 24 hours later off-site, while 7 persons were rescued.

“Consequently, the Authority commiserates with the families of the deceased persons and pray that the good Lord will repose the souls of the departed”.

He said that upon the receipt of the report of the accident through its community-based structure, the NIWA deployed its search and rescue team to the scene for immediate rescue activities.

According to him, the team and other stakeholders including the local divers, swung into action and have continued the search and rescue effort since Wednesday.

“As of the last count, one person is still unaccounted for.

“Also, the Marine Department of NIWA has activated its accident investigation mechanism to determine the cause(s) of the accident and make appropriate recommendations,” he said

The manager stressed the need for all users of the inland waterways to, mandatorily, adhere to all the established safety protocols, including the completion of passenger manifest at the loading and offloading points.

“The usage of life jackets on the waterways is mandatory, avoiding over speeding, and yielding to weather dictates, at all times,” he said.

Horsfall commended the Marine Police, local divers/ fishermen, Maritime Unions and other good-hearted Nigerians who rose to support the Authority in its rescue efforts.

“Nevertheless, NIWA hereby assures all Nigerians of its continuous efforts aimed at promoting safer inland waterways for the use of all”.

In another development, the Managing Director of the Nigerian Film Corporation (NFC), Mr Ali Nuhu has said that recent deaths in the movie industry have robbed the nation of legendary filmmakers.

This is contained in a statement signed by Brian Etuk,  the Director of Public Affairs of the NFC in Abuja.

Nuhu described the death of Saratu Gidado (aka Daso) and John Odonwodo,  known as Junior Pope, as heart-wrenching for colleagues and film industry stakeholders.

”Their deaths, which occurred within the week has left  Nigeria’s movie industry in a state of mourning.

”Stakeholders have been pained by the frequent recent losses robbing the country of legendary filmmakers,  who have impacted and contributed greatly to the growth of Nigeria’s film industry.

“Their footprints within the development of the Nigerian film industry will not be forgotten,” he said.

Speaking about the late Gidado, the NFC boss said she caught the fancy and interest of Nigerians, particularly as a lead character in several of Kannywood films,  such as ‘Linzami Da Wuta’ and ‘Gidauniya’.

”She was a Zuma Film Festival(ZUFF)  2023 Life Time Achievers Awardee but sadly succumbed to death in the early hours of Tuesday, April 9.

“Odonwodo’s role in showcasing the professional competencies and screen delivery by actors is remarkable,  as can be found in ‘Honey Money’, ‘Blood Affair’ and ‘Wrong Initiation’ movies in which the late actor acted.

 “While Mr Ibu delivered that evoked laughter and comic relief,  leaving behind a gap to be filled, the refined gentlemen shall be greatly missed,” he added.

Nuhu pledged that the NFC would continue to support the film industry policy initiatives that promoted friendly and safe working conditions,  including medical, health and life insurance schemes for stakeholders.

Nuhu also sympathised with the immediate families, friends and associates of the deceased, as well as the Actors Guild of Nigeria (AGN) and prayed that Almighty God grant them rest.
